Restraining Orders and Protective Orders

Occasionally Restraining Orders and Protective Orders are filed during the course of a divorce proceeding. Common is a protective order filed by the County Attorney's Office separately prior to the divorce or after the divorce has been initiated. Usually it involves some kind of alleged domestic violence or perhaps child abuse. Orders can be made during this hearing about where the children should temporarily reside. If a finding of Family Violence is made against you it can significantly impair any future divorce litigation. Also if you violate the Order you can go to jail. So, these actions against you can be very serious both pre and post divorce. Some parents will falsify a report to the County Attorney's Office mostly because I think it is fairly easy and painless to do so. If you can show a parent purposely did that then the court would have grounds to switch custody and award you the children. I've seen this happen on several occasions but again this requires a good deal of investigation from a skilled private investigator familiar with the process to provide the court with evidence.
